Do you have a loved one who is in a nursing home and receiving Medicaid?

Please be aware that some facilities are making the residents sign over their stimulus checks to the facility.  The facility is saying because the resident is on Medicaid, the resident cannot have the stimulus check.  THIS IS INCORRECT.  The CARES Act and the tax code (26 U.S.C. §6409) make it clear that refunds are disregarded in the administration of Federal programs such as Medicaid and will not count as a “resource.”  Therefore the resident can keep the stimulus check.
